Scope and acceptance

These Terms & Conditions ("Terms") apply to all purchases made through silexd.com by any person acting as a consumer or professional (the "Customer"). Placing an order constitutes full acceptance of these Terms, which are available at all times on the Website and may be saved or printed by the Customer.

These Terms govern the sale of products only. Use of the Website itself is governed by our Legal Warning, and the processing of personal data is governed by our Privacy Policy.

Eligibility and age restriction

SILEXD reserves the right to request proof of age and to refuse or cancel any order where there is reasonable doubt that this requirement is met. All shipments are dispatched in neutral, discreet packaging with no external reference to the contents.

Products, descriptions and prices

SILEXD makes reasonable efforts to display product images, materials, dimensions, and descriptions accurately. Minor variations between the images shown on the Website and the actual product (due to screen settings, lighting, or manufacturing tolerances) do not constitute a lack of conformity.

Prices are shown in the currency selected on the Website and include applicable VAT, unless stated otherwise. Shipping costs, where applicable, are shown separately before the order is confirmed. SILEXD reserves the right to modify prices at any time, without this affecting orders already confirmed.

Ordering process

To place an order, the Customer must select the desired products, add them to the cart, and follow the checkout steps, providing accurate identification, delivery, and payment details. Before confirming the order, the Customer will be able to review and correct any errors.

Once the order is placed, SILEXD will send a confirmation email summarising the products purchased, the price, and the estimated delivery date. This confirmation constitutes acceptance of the purchase contract. SILEXD reserves the right to refuse or cancel an order in cases of product unavailability, pricing errors, or reasonable suspicion of fraud, in which case the Customer will be notified and any amount already paid will be refunded.

Payment

Payment can be made using the methods indicated on the Website at checkout (such as credit or debit card, or other payment providers made available from time to time). Payments are processed through secure, encrypted third-party payment gateways; SILEXD does not store full payment card details.

The order will only be processed once payment has been successfully confirmed.

Shipping and delivery

Estimated delivery times are shown at checkout and are provided for guidance only; they may vary depending on destination and carrier availability. SILEXD is not liable for delays caused by the carrier, customs procedures, or circumstances beyond its reasonable control.

Risk of loss or damage to products passes to the Customer once the products have been delivered to the address provided at checkout. The Customer is responsible for checking that the delivery details provided are correct.

Right of withdrawal

In accordance with Directive 2011/83/EU and applicable Spanish consumer protection law, consumers resident in the European Union have the right to withdraw from a purchase within 14 calendar days from the date of delivery, without the need to give any reason.

To exercise this right, the Customer must notify SILEXD of the decision to withdraw by unequivocal statement, sent to info@cnex.es, before the withdrawal period expires. Products must be returned in their original, unopened, and sealed condition, together with proof of purchase.

Where the right of withdrawal applies, SILEXD will refund all payments received, including standard delivery costs, within 14 days of being informed of the Customer's decision, using the same payment method used for the original transaction, unless otherwise agreed. SILEXD may withhold the refund until the returned product has been received, or until the Customer has provided proof of having sent it back, whichever is earlier. Return shipping costs are borne by the Customer unless the return is due to a defective or incorrect product.

Legal warranty and returns

Products sold on silexd.com benefit from the legal warranty of conformity provided for under applicable Spanish and EU consumer law. If a product is faulty or does not conform to what was ordered, the Customer should contact info@cnex.es as soon as reasonably possible, describing the issue and, where relevant, attaching photographs.

Depending on the circumstances, SILEXD will offer repair, replacement, a price reduction, or, where appropriate, termination of the contract and a full refund, in accordance with applicable law. This legal warranty is independent of, and unaffected by, the withdrawal exception described in Section 8 for sealed intimate products.

Liability

SILEXD shall be liable for non-conformity of products in accordance with applicable consumer protection law. SILEXD's liability shall not extend to damages resulting from improper use, use contrary to the product's care and usage instructions, normal wear and tear, or misuse by the Customer or third parties.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or liability for fraud.

Intellectual property

All content on the Website, including trademarks such as SILEXD and SILEXPAN, product designs, images, and text, is the property of SILEXD or its licensors and is protected by intellectual and industrial property law. Purchasing a product does not grant the Customer any rights over such intellectual property, beyond the private use of the product itself.

Complaints and dispute resolution

Any complaint may be sent to info@cnex.es. Consumers resident in the European Union may also access the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr to submit complaints out of court.

Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute arising from the purchase of products through the Website shall be submitted to the Courts and Tribunals of Mataró (Barcelona), without prejudice to any mandatory venue rules that apply where the Customer is a consumer, in which case the fora provided for by applicable consumer protection law shall prevail.

Changes to these Terms

SILEXD reserves the right to amend these Terms at any time. The version published on the Website at the time an order is placed shall be the version applicable to that order. We recommend reviewing this page periodically before making a purchase.
